Former President Alberto Fernández filed an appeal against the indictment in the Insurance case , where he is being investigated for the alleged crime of negotiations incompatible with the exercise of public office . The measure was adopted by Judge Sebastián Casanello, who held that there were irregularities in contracts entered into by state agencies through Nación Seguros.
His defense attorney, Mariana Barbitta, argued that the prosecution was based on new facts that were not included in the investigation. Barbitta considered that her client was accused of "novel conduct" that "was never imputed to him in the summons or in the hearings." After learning of his indictment, Alberto Fernández posted a message on the social network X. “Yesterday, the Federal (in) Justice ordered my indictment. They are no longer questioning me about a decree I signed to put an end to cartelization and the deals being made with state insurance companies. Now, suddenly, I am accused of not having warned of the 'risk' posed by appointing the wife of an insurance producer as my secretary,” he wrote.
The former president denounced politically motivated persecution. He claimed the measure was the result of a forced reading of the evidence, "with the sole purpose of arbitrarily keeping me tied to the process." Despite his criticism, he asserted that he will continue to defend his innocence in court.
The statement released by his law firm described the prosecution as "arbitrary" for acts "for which he was not investigated." They warned that the principle of consistency was violated and noted that the case is based on a complaint "without a serious, comprehensive, or objective investigation."
In addition to Fernández, the judge also indicted businessman Héctor Martínez Sosa , his partner María Cantero , former head of Nación Seguros Alberto Pagliano, and other former board members.
